The Legality of Pepper Spray

Did you know that pepper spray is legal in all 50 United States However, while you would think that we have a legal right to protect ourselves with non-lethal devices no matter where we are, this simply is NOT the case. Despite the fact the OC Pepper Spray has never been found to seriously injure anyone and had been found responsible for helping to protect those who have used it, including members of the law enforcement community and civilians alike, there are places that have placed restrictions on the purchase, possession or placed limitations on the size or chemical makeup of the spray. Many of these restrictions and laws are based on the history and perception of the old-fashion tear gas. Some of these have to do with preventing acts of terrorism. For example, you can’t carry it in air port, on in carry-on bags for airplanes, or checked luggage at airports or government buildings, and there are some business that do not allow their employees to have pepper spray on the premises (but they can have guns ?)

Therefore, before your purchase or carry pepper spray it is wise that you check with your local law enforcement, city ordinances, and/or city attorney office before you purchase or carry a defense spray of any kind.

We know for sure that you CANNOT carry or use a defense spray on a commercial airline. The last thing you would want to happen is for that pressurized spray canister to leak or explode on an air craft where pilots have to see and breathe, and you can’t just open window.
